How do I check if my business name is available?

Three separate checks, and most people only do one of them.

The short answer
Check the state registry, the web address, and trademarks. Passing one does not mean passing the others.

1. Your state registry

Every state keeps a list of registered business names, and it will reject yours if it is too similar to an existing one. This is the only check that can stop your formation outright.

2. The web address

Even if you do not want a website yet, grab the domain. It costs about twelve dollars a year and it is far cheaper than rebranding in eighteen months because someone else took it.

3. Trademarks

This is the one people skip, and the one that can cost you the most. A name can be free in your state and still belong to someone nationally. If a company in your industry holds the trademark, you may be forced to rename after you have printed signage and built a following.

Similar is not always a problem
Trademarks are industry-specific. A clothing brand with your name is usually fine if you run a bakery. Same industry is where it gets serious.

Then act quickly

Availability is a snapshot, not a reservation. If the name checks out and you are serious, form the business — that is what actually secures it in your state.
